• Engage in any data mining, scraping, or similar data gathering activities;
• Upload or transmit viruses, malware, or other types of malicious software;
• Use the Service in any way that could damage, disable, overburden, or impair the Service.

6. Intellectual Property Rights

6.1 Service Content

The Service and its original content, features, and functionality are and will remain the exclusive property of Zap GeneratorTool and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Zap GeneratorTool.

6.2 Generated Content

The usernames, business names, hashtags, and other content generated through our Service are provided for your personal or business use. While we do not claim ownership of the specific usernames, business names, or hashtags that you generate using our tools, we retain all rights to the algorithms, processes, and methods used to generate such content.

6.3 License to Use Generated Content

Subject to your compliance with these Terms, Zap GeneratorTool grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use content generated through our Service for your personal or business purposes.

7. User-Generated Content

7.1 Content Ownership

You retain ownership rights in any user-generated content that you submit, post, or display on or through the Service. By providing user-generated content to Zap GeneratorTool, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods now known or later developed.

7.2 Content Responsibility

You are solely responsible for any user-generated content that you submit, post, or display on or through the Service. You represent and warrant that:

• You own the content or have the necessary licenses, rights, consents, and permissions to use and authorize Zap GeneratorTool to use the content;
• The content does not infringe or violate the rights of any third party, including without limitation any intellectual property rights, privacy rights, or publicity rights; and
• The content complies with these Terms and all applicable laws.

8. Payment Terms

8.1 Free and Premium Services

Zap GeneratorTool offers both free and premium (paid) services. By signing up for a premium service, you agree to pay the applicable fees as they become due. All fees are exclusive of taxes, levies, or duties imposed by taxing authorities, which are your responsibility.

8.2 Billing and Renewals

For premium services, we use third-party payment processors to bill you through a payment account linked to your account. Billing cycles are set on a monthly or annual basis, depending on the type of subscription you select. By default, all premium subscriptions are set to automatically renew for the same subscription period.

8.3 Refunds

Fees paid for premium services are non-refundable except as required by law or as explicitly stated in these Terms. If you believe that Zap GeneratorTool has charged you in error, you must contact us within 30 days of such charge.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers

The Service and all content provided through the Service are provided on an "as is" and "as available" basis. Zap GeneratorTool makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Zap GeneratorTool does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Service or otherwise relating to such materials or on any websites linked to the Service.

11. Limitation of Liability

In no event shall Zap GeneratorTool, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
• Any claim that your user-generated content caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
